Resolving Legal Obstacles to Productive Waqf Asset Certification to Attract Regional Private Investment

Abstract

Administrative governance issues and the low legality of religious assets are major obstacles blocking macroeconomic potential in Lampung Province. These legal certification obstacles are triggered by negligence in recording Waqf Pledge Deeds in the past, oral waqf traditions, and poor intergenerational archival management. Consequently, the risk of disputes with heirs arises as land market values ​​soar, transforming into a major disincentive for third-party investment capital because assets are deemed not to meet clear and clean qualifications. This policy analysis uses a qualitative-descriptive approach by applying the Urgency, Seriousness, and Growth (USG) method to determine problem priorities, and a fishbone diagram to unravel the root causes of obstacles. Furthermore, the formulation and evaluation of policy alternatives are separated and weighted in a structured manner using William N. Dunn's policy evaluation criteria, which include aspects of effectiveness, efficiency, adequacy, equality, responsiveness, and accuracy. The results of Dunn's scoring analysis indicate that the best recommendation to break this vicious cycle of bureaucracy is the ratification of a Joint Regulation between the Minister of Religious Affairs and the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency concerning the Acceleration of Systematic Registration of Productive Waqf Assets. Through this authoritative macro-legal instrument, the government can eliminate clerical neglect at the grassroots level, grant administrative amnesty for lost historical documents, and integrate physical databases into digital platforms. This top-down, cross-sectoral intervention is an absolute prerequisite for restoring a healthy investment climate, ensuring certainty of land rights, and restoring the essential function of religious assets as a driving force for sustainable economic prosperity in Lampung Province.
